Terms of Service

These Terms of Service ("Terms") govern the supply of products and services by Fortress Freedom Phone Ltd ("Fortress", "we", "us") to you ("the customer", "you"). By placing an order or accepting delivery, you agree to these Terms together with our Acceptable Use Policy and Privacy Policy.

1. About us

Fortress Freedom Phone Ltd is a private limited company registered in England & Wales (Companies House No. 17168647). You can reach us at admin@fortressfreedomphone.co.uk, on Telegram at @FREEDOM_PHONE, or by phone on 07822 016492.

2. The service we provide

We supply two product tiers, described in full on our home page:

Devices are pre-configured and tested before dispatch. The customer sets a PIN on first boot; no further setup is required for ordinary use.

3. Pricing & payment

Current prices are set out on our home page and are inclusive of any VAT we are required to charge. We accept payment by cash (in person or by post), UK bank transfer, debit/credit card, and cryptocurrency. Payment is due in full at the time of order unless we have agreed alternative terms in writing.

For subscription services, monthly fees are billed in advance. We reserve the right to vary prices on 30 days' written notice; you may terminate the subscription within that notice period without further charge if you do not accept the variation.

4. Order acceptance

An order is accepted when we confirm it to you in writing (by email or messaging). We reserve the right to refuse any order at our sole discretion, including but not limited to where we reasonably suspect the order falls outside the lawful uses set out in our Acceptable Use Policy. Where we refuse an order, any payment taken in respect of that order will be refunded in full within 14 days.

5. Delivery, collection & risk

Same-day dispatch is available on orders placed before 3pm UK time, Monday to Friday, subject to stock and any required customer screening. Standard delivery is by tracked, signed-for courier in plain packaging. Collection in central London is available by prior appointment.

Risk in the device passes to you on delivery (or, where collection is agreed, on handover). Title in the device passes to you on receipt of payment in full.

6. Your right to cancel (Consumer Contracts Regulations 2013)

If you are a consumer (i.e. acting outside your trade, business, craft or profession), you have a statutory right to cancel any contract entered into at a distance within 14 days of receiving the device, without giving any reason. To exercise this right, notify us by email at admin@fortressfreedomphone.co.uk within the 14-day period.

Where you cancel, you must return the device to us in re-saleable condition within 14 days of giving notice. Return shipping is at your expense. We will refund the price you paid for the device within 14 days of receiving it back, less any deduction for diminution in value caused by handling beyond what was necessary to inspect the device.

This statutory right does not apply to ongoing managed-line subscription fees for any period of service that has already been provided to you at the time of cancellation.

7. Returns, faults & statutory rights

If a device develops a fault that is not the result of customer-caused damage, contact us as soon as you discover it. Under the Consumer Rights Act 2015, you are entitled to:

Nothing in these Terms limits or excludes your statutory rights as a consumer.

8. Acceptable use

Your use of any Fortress product or service is at all times subject to our Acceptable Use Policy. We may suspend or terminate any service immediately for breach of that policy, and where we do so for breach, no refund of subscription fees is due.

9. Service availability

We aim to keep managed-line services available continuously, but we do not warrant uninterrupted availability. From time to time, services may be unavailable due to scheduled maintenance, upstream-network incidents, or events outside our reasonable control. Where service is unavailable for an extended period for reasons within our control, we will at our discretion provide a pro-rata service credit on application.

10. Liability

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any matter for which it would be unlawful for us to limit liability; or your statutory rights as a consumer.

Subject to the paragraph above, our total liability to you in connection with any contract for the supply of products or services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the price you paid for the device or, for subscription services, the fees paid by you in the twelve months preceding the event giving rise to the claim.

We are not liable for any indirect or consequential loss, loss of profit, loss of business, loss of anticipated savings, or loss of data.

11. Termination

For ongoing subscription services, you may cancel at any time by giving us 30 days' written notice. We may terminate any service for material breach of these Terms or our Acceptable Use Policy, for non-payment, or where required by law or by a valid order of a competent authority.

On termination of a managed-line subscription, the line will be deactivated at the end of the current billing period (or earlier where required). The customer's hardened handset, if purchased outright, remains the property of the customer.

12. Changes to these Terms

We may update these Terms from time to time. The current version is identified at the top of this page. Material changes will be brought to the attention of active customers by email at the address held on file. Continued use of the service after a material change constitutes acceptance of the updated Terms.

13. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction, except that consumers resident in another part of the United Kingdom may bring proceedings in the courts of their home jurisdiction.
